Creator Agreement

This document is written for a premium creator, subscription, digital content, and shop marketplace. It is intended to be read together with the other documents in the Legal Center.
1. Scope
This Creator Agreement applies to all creators, models, sellers, promoters, and payout recipients who monetize content, subscriptions, messages, tips, or products through TrulyFeetFans.
2. Verification and Eligibility
- Creators must be adults and must complete required identity and age checks.
- Creators must provide accurate payout, tax, and profile information.
- The platform may require re-verification if risk, fraud, compliance, or rights concerns arise.
3. Content Ownership and License
Creators retain ownership of their lawful original content. They grant the platform the license required to host, display, transmit, secure, moderate, promote, watermark, and make content available to paying users according to platform functionality.
4. Consent and Documentation
Creators must obtain and retain written consent, age verification, identity records, and release documentation for every depicted person. Documentation must confirm consent to creation, upload, public or restricted distribution, monetization, and platform processing.
5. Prohibited Creator Conduct
- Uploading content without consent or rights clearance.
- Using third-party payout accounts to hide control or exploitation.
- Publishing stolen, leaked, AI-manipulated, or impersonation content.
- Misrepresenting pricing, fulfillment, identity, location, product details, or availability.
6. Earnings and Payouts
Creator earnings are subject to platform fees, taxes, payment-provider fees, refunds, chargebacks, reserves, fraud review, and payout method restrictions. Payouts may be delayed or withheld where required for legal, fraud, tax, rights, or provider reasons.
7. Taxes and Reporting
Creators are responsible for their own taxes and business registrations unless law requires platform reporting or withholding. The platform may request tax information and may report creator earnings where legally required.
8. Enforcement and Termination
Violation of this agreement may result in content removal, monetization restriction, payout hold, account termination, evidence preservation, and authority reporting.

10. Creator Account Management
Creators must keep control of their own account, email, verification method, payout method, and password. If an agency, assistant, or promoter supports the creator, the creator remains responsible for all activity and must ensure no third party exercises coercive control.
11. Custom Content and Product Fulfillment
If custom content or shop products are offered, creators must describe the offer accurately, state delivery limitations, avoid illegal requests, and decline requests that would violate consent, safety, IP, privacy, or platform rules.
12. Exclusivity and Off-Platform Solicitation
Unless a separate written agreement says otherwise, this agreement is not exclusive. However, creators may not use the platform to route buyers into unsafe, fraudulent, illegal, or payment-circumventing transactions.
13. Records and Audits
The platform may request consent records, identity records, tax records, rights licenses, release forms, and transaction explanations. Failure to provide credible records may result in content restriction or payout hold.
14. Platform Promotion
Creators grant permission for limited on-platform and platform-owned promotional use of profile names, public preview images, bios, categories, and lawful preview snippets, subject to privacy settings and applicable law.
15. Survival
Rights and obligations concerning payments, chargebacks, taxes, content licenses for delivered purchases, legal claims, audit records, confidentiality, and prohibited content survive account closure.
